Effective as of 1 July 2026
These Terms govern the use of the AI Assistant service (the “Service”) provided by Individual Entrepreneur Volodymyr Vasylovych Teteruk. By using the Service, you agree to these Terms.
1. Description of the Service
AI Assistant is a platform that provides businesses with automated AI assistants for communicating with their customers in Instagram Direct and Facebook Messenger, including general support, appointments and bookings, with the option of handing the conversation over to a human manager.
2. Who is a Client
A “Client” is a business or person that connects its own Meta accounts to the Service to serve its customers. The Client is responsible for the lawfulness of such customer service, for having proper legal grounds to process its customers’ data and for complying with Meta’s policies. The Client confirms that it has its own privacy policy for its customers and accepts the terms of the Meta platforms. The Service is intended for business use; end users’ communication in Meta channels is governed by the rules of the relevant platforms, including the minimum age requirement (13 years).
3. Automated replies
Replies are generated by an AI model and may contain inaccuracies. The Service does not replace professional advice. Users are informed in the conversation that they are communicating with an automated assistant, and may ask to be connected to a human.
4. Acceptable use
By using the Service, you agree:
- not to use the Service for unlawful or fraudulent activities, spam or distribution of prohibited content;
- not to infringe the rights of third parties or Meta’s platform policies;
- not to attempt to gain unauthorised access to the Service or disrupt its operation.
5. Data and privacy
The processing of personal data is governed by the Privacy Policy. With regard to end users’ data, the Client is the controller and AI Assistant is the processor; the terms of such processing on the Client’s instructions form part of the arrangement with the Client.
6. Intellectual property
All rights to the AI Assistant platform, its code, configurations and materials belong to us. The Client receives a non-exclusive right to use the Service for the duration of the arrangement and retains all rights to its own content and its customers’ data.
7. Term and termination
Either party may stop using the Service by giving the other advance notice. We may suspend or terminate access in the event of a breach of these Terms or Meta’s policies. Upon termination, the Client’s data is deleted or anonymised in accordance with the Privacy Policy.
8. Availability and changes
We strive to keep the Service running reliably but do not guarantee its uninterrupted availability. The Service depends on third-party platforms and providers (Meta, CRMs, the AI model provider); we are not responsible for their outages. We may change the Service’s functionality and these Terms; the current version is published on this page.
9. Disclaimer of warranties and limitation of liability
The Service is provided “as is”. To the extent permitted by law, we are not liable for indirect or consequential damages arising from the use of, or inability to use, the Service, including the content of automated replies. Our aggregate liability for any claims is limited to the amount paid by the Client for the Service in the 12 months preceding the event giving rise to the claim.
10. Governing law
These Terms are governed by the laws of Ukraine. Disputes are resolved through negotiations and, failing agreement, in court in accordance with the laws of Ukraine.
